За что отвечает кипрский финансовый регулятор CySEC

Кипрский регулятор CySEC ответил человеку, которого пытались обмануть мошенники от имени регулятора.

В письме сказано, что CySEC не уполномочивал никого действовать в своих интересах.

Также говорится, что об этом способе мошенничества CySEC делал публичные предупреждения в июле 2021 года и в июле 2018 года.

Также регулятор даёт ссылки на организации и домены, к регулированию которых он имеет отношение. К ним лжеброкер FinxTrade, обманувший человека, не относится.

Dear Sir,

The Cyprus Securities and Exchange Commission (CySEC) is the independent public supervisory Authority responsible for the supervision of the investment services market and transactions in transferable securities carried out in the Republic of Cyprus.

Further to the email below, we note that CySEC has not appointed anyone to act on its behalf.

We note that due to the phenomenon of persons impersonating CySEC representatives, CySEC has issued multiple warnings. Please refer to our website and the latest relevant Announcements, i.e. Announcement, dated 22 July 2021 and Announcement, dated 2 July 2018.

Additionally, please note that the Authorisations’ Department does not handle complaints.

Please note that all the information on how to submit your complaint can be found on CySEC’s webpage (https://www.cysec.gov.cy/en-GB/investor-protection/how-to-complain/).

However, further to your email below, please refer to our website where all investment firms regulated by the Cyprus Securities and Exchange Commission (CySEC) are listed (click here). Please note that the entire list of regulated entities by CySEC can be seen here. We note that each entity’s approved domain(s) is also listed on our website (available here).

All former investment firms (CYPRIOT) are listed here. We also wish to draw your attention to the list of non-approved domains on our website (click here).

If the company/companies you refer to below is listed on our website we note that as per the information on our website available here, the Cyprus Securities and Exchange Commission (the ‘CySEC’) does not have restitution powers and therefore does not investigate individual complaints. However all complaints submitted to the CySEC are taken into consideration by the CySEC in the performance of its supervisory mandate.

If you are unhappy with a financial product or service provided to you by a Cyprus Investment Firm (a ‘CIF’), follow the following three steps set out on our website (also available here) for making a complaint.

Step 1: Contact the CIF directly
If you have a complaint, it is best to first ask the CIF involved to put things right.
The CIF will give you a unique reference number. This unique number reference will be used for all future communication you will have with the Financial Ombudsman and/or with CySEC regarding your complaint.
CIF’s are required to respond in writing within five days just to let you know they have received your complaint.
CIF’s are also required to respond to your complaint in writing within two months, telling you whether the complaint has been successfully resolved or why they need more time to look into it (within maximum three months from the day of the complaint).

Step 2: Contact the Financial Ombudsman
If you are not satisfied with the firm’s response, they rejected your complaint or you do not have answer from them within three months, it is recommended that you check with the office of the Financial Ombudsman in case you are eligible to file a complaint with them and seek mediation for possible compensation.
The Financial Ombudsman is an independent service for settling disputes between CIF’s and their clients.
It is important to contact the Financial Ombudsman within four months of receiving a final response from CIF otherwise the Financial Ombudsman may not be able to deal with your complaint.

Step 3: Take the matter to court
If you do not want to accept a decision taken by the Financial Ombudsman as a last resort you may be able to take your case to court. You would usually start civil action in the District Court.

On the other hand, if the company/companies you refer to below is not listed on our website and it is offering investment services from/within Cyprus, please fill out this form on our website.
