The Aruba Financial Services Commission (AFSC) announces that, at its meeting on August 07 2023, it has taken a decision in accordance with sections 23 (1) (b), (c) and 24 (4) (b) on Financial Regulation and the Control Act in force money laundering of 2007 (hereinafter – the “Law”) on reimbursement in accordance with the rolling reserve procedure from the authorization of the payment service with number 131-22-84 in the register of “Naspay LTD”, “QuantomSystem LTD” (hereinafter the “Companies”)., in connection with the failure of the Companies to comply with Article 28 (1) of the Law, since it did not
comply with:
1. The refund procedure refund reserve provided for in:
11 Art. 12 (1) of the Act, Naspay LTD was not required to provide a payment service to a brokerage QuantomSystem LTD organization that is not licensed.
12 Art. 13 (2) of the Law, the QuantomSystem LTD does not have the proper documents to conclude a real exchange. The provision of trade services was carried out with clear signs of fraud and was not observed in the current advertising for the provision of trade services.
2. The condition of authorization provided for in section 18 (2) (c) of the Law, AFSC confirms violations on the part of the payment service Naspay LTD and the organizations of QuantomSystem LTD that used the former to transfer payments.
2.1 Additional costs that may arise when transferring funds are paid by the Customer from personal funds.
